Construction Permits

“Construction Permits” are required before constructing, installing, replacing, or modifying stationary equipment and processes that emit air pollution.

These permits are part of our “New Source Review” program in NWCAA Regulation 300.

What is a General Order? A General Order is a type of construction permit but it’s faster and less expensive to obtain. General Orders are only available for qualifying autobody spray coating booths and gas stations (see below).

Permit exemptions: Some processes and equipment that emit very little air pollution are exempt from construction permits. See NWCAA Regulation 300.3 and 300.4 for exemptions.

Construction Permit Application Forms: Follow steps 1 through 5 to apply

1) Fill out the General Form

2) Fill out equipment form: Baghouse Cartridge-type, Gas station Stage I & II, Gas station Stage II removal, Rock crusher, Spray coating operation

3) Fill out SEPA checklist or provide copy of SEPA determination for your project

4) Submit forms by email or mail to NWCAA – Permit Application 1600 S. 2nd St, Mount Vernon WA 98273

5) Pay filing fee online or submit by mail with forms. (See NSR fee schedule (2025) or NSR fee schedule (2026) for filing fee amount; note that additional fees will be billed by NWCAA per the fee schedule)

Other Permits that NWCAA can issue

We can issue other (less common) permits as “Orders” to effectuate and enforce the WA Clean Air Act. See NWCAA Regulation 121.
